1.1. These Terms and Conditions ("Terms") govern your access to and use of BotoxSearch ("BotoxSearch / App / Service"). Please read these Terms carefully. By accessing or using our Service, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Service.

1.2. These Terms apply to BotoxSearch's app available on the Apple App Store and Google Play Store, and any associated services.

1.3. BotoxSearch is operated by The Friendly App Ltd ("we," "us," "our," or "The Friendly App Ltd"). These Terms constitute the legal and binding agreement between The Friendly App Ltd and the User.

2. Definitions

For the purposes of these Terms, the following definitions shall apply:

App: Refers to the BotoxSearch mobile application.

Search: Refers to searches for botox clinics and providers conducted using BotoxSearch, based on publicly available information.

User: Refers to any individual who accesses or uses the Services provided by BotoxSearch.

Clinic Information: Refers to publicly available information about botox providers, including but not limited to names, locations, contact details, reviews, and pricing.

Subscription: Refers to paid access plans that provide full functionality of the App.

3. General Terms of Use

3.1. By accessing or using BotoxSearch, you agree that these Terms, Privacy Policy, and all other policies stated herein are deemed to have been read and accepted. Your use of the App constitutes acceptance of these Terms.

3.2. You must be at least 18 years of age to use BotoxSearch. By using the App, you confirm that you are of legal age.

3.3. Users who cannot fulfill the conditions stipulated in these Terms or the Privacy Policy should not download or use BotoxSearch.

🔍 Information Facilitation Service Only

BotoxSearch is a search facilitation tool designed to help users find botox clinics and providers. We do NOT provide medical advice, endorse specific clinics, facilitate bookings, or offer treatment services. Our service exists solely to aggregate and present publicly available information. All treatment decisions and clinic selections should be made in consultation with qualified medical professionals. We are not responsible for the quality of services provided by any clinic found through our App.

4. Changes to Terms

4.1. We may make changes to these Terms from time to time at our sole discretion. We may introduce new services, features, or additional conditions.

4.2. We will provide reasonable notice about alterations or revisions, but you should check these Terms each time you access BotoxSearch. The updated Terms will enter into force on the date of publication. Your continued use after any changes constitutes acceptance of the new Terms.

5. Use of Content and Services

5.1. The use of BotoxSearch is subject to the conditions specified in these Terms and applicable legislation.

5.2. We do not undertake responsibility for the accuracy and reliability of information about third-party clinics, or external websites to which links are provided. You are obliged to comply with the usage and privacy policies of such third-party websites. If you decide to contact or visit clinics found through our App, you do so at your own risk.

5.3. Users may not use BotoxSearch for commercial purposes without our prior written approval.

5.4. Users can use the App by downloading it from the Apple App Store or Google Play Store and choosing the subscription package they want.

5.5. BotoxSearch offers weekly and yearly subscription packages. Subscription cancellation can be done at any time via the Apple App Store or Google Play Store settings.

5.6. All subscription packages are as presented in the App at the time of purchase. We reserve the right to change the content of future packages. New or additional packages may be offered as services develop.

5.7. BotoxSearch is an AI-powered search service that helps users find botox clinics and providers. Please note that:

Information is based on publicly available sources only
Users can see sources of information following their searches
Information may be incomplete, inaccurate, or not up-to-date
Users should validate search results through direct contact with clinics
Search outputs may not be completely original due to the nature of AI technology

5.8. If information is incorrect, incomplete, or outdated, users can report issues through the App's feedback system.

6. User Responsibilities

6.1. We take reasonable data security measures to protect user privacy in compliance with applicable data protection regulations. Please review our Privacy Policy for details.

6.2. You are responsible for your internet service, hardware, software, mobile device, and service providers used when accessing BotoxSearch. We have no liability for issues arising from your device or internet access.

6.3. We may specify device or version requirements for using the App. We may determine that the App can only be used on devices meeting certain qualifications. You will have no claims arising from this.

6.4. There may be updates to the App from time to time. During updates or maintenance, you may not be able to access BotoxSearch temporarily. You will have no claims against us in this regard.

6.5. We may introduce additional features and may charge additional fees or create separate subscription models for such features. You acknowledge that future additions or revisions may not be within the scope of every subscription package.

6.6. If you do not keep your login information confidential or share your account, you are fully responsible for all activities and any unauthorized purchases. We cannot be held responsible for damages arising from unauthorized account access.

6.7. Each account is created for a single user and cannot be shared with third parties. We cannot be held responsible for technical problems or legal consequences arising from account sharing.

6.8. We have no responsibility for the accuracy, completeness, or quality of clinic information. We cannot be held responsible for any damages that may arise from use of information provided through the App.

6.9. There may be links to external websites or social media platforms. These links are for reference purposes only. There is no partnership or sponsorship with these platforms. BotoxSearch only compiles and presents publicly available information.

6.10. The purpose of BotoxSearch is informational only. The App should only be used for finding and comparing botox providers. We reserve all legal rights regarding other uses.

7. Search History and Saved Clinics

7.1. Search history may be limited for a specific time period. Users can refresh their information by conducting new searches.

7.2. It is prohibited to use search results for purposes other than personal informational use. You accept all responsibility for any commercial, immoral, or illegal use of information obtained through the App.

8. Subscription and Payment

8.1. If you do not cancel your subscription within the subscription period, it will automatically renew.

8.2. Subscription models offered are weekly and yearly. These models are based on the options and pricing offered at the time you start your subscription. New subscription models may be offered later but may not be included in the scope of your initial subscription.

8.3. Weekly subscriptions provide access to unlimited searches for one week and automatically renew unless canceled.

8.4. Yearly subscriptions provide access to unlimited searches for one year and automatically renew unless canceled.

8.5. Upon cancellation, access to BotoxSearch continues until the end of the current subscription period. At the end of the period, access and services will expire.

8.6. Refund policies and procedures of the Apple App Store or Google Play Store apply. After cancellation, the App will be accessible until the end of the subscription period. There are no refunds except as stated in the policies of the app store from which you downloaded the App. We are not responsible for any errors in the payment system of these services. We do not collect credit card information; all payments are processed by Apple or Google.

9. No Warranty and Limitations

9.1. BotoxSearch and its content are provided "as is" without any warranty, written or verbal, to the fullest extent permitted by law.

9.2. We do not guarantee that BotoxSearch is safe, error-free, that defects will be corrected, or that servers are virus-free.

9.3. We are not responsible for:

The use or inability to use the App or its content
The accuracy, completeness, or quality of clinic information and search results
Any decisions made based on information from the App
Any errors, omissions, or inaccuracies in content
Unauthorized access to user accounts or data
Any other problems related to the App or services

9.4. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from use of the App, including but not limited to lost profits, data loss, or financial loss. Total liability for any claims shall be limited to the amount you paid for your subscription in the twelve months preceding the claim. All claims must be brought within one (1) year from the date of the event giving rise to the claim.

BotoxSearch does not provide medical advice, diagnosis, or treatment recommendations. Information presented through the App is for informational purposes only and should not be considered a substitute for professional medical advice. Always consult with qualified healthcare providers before undergoing any cosmetic procedure. We are not liable for any medical outcomes, complications, or dissatisfaction with services provided by clinics found through our App.

10. Personal Data and Privacy

10.1. The protection and privacy of your personal data is important to us. Please read our Privacy Policy for detailed information regarding the processing of your personal data.

11. Intellectual Property Rights

11.1. All intellectual property rights in BotoxSearch, including content, images, materials, functions, and tools, belong exclusively to The Friendly App Ltd.

11.2. We own all promotional materials, data files, text, information, designs, logos, icons, and other materials presented in the App.

11.3. No part of the App or its contents may be copied, reproduced, distributed, published, streamed, exhibited, loaned, modified, or used without permission.

11.4. These elements cannot be used for commercial or personal purposes without written permission. It is prohibited to publish any elements in other media or websites without written permission.

11.5. We grant you a non-exclusive, non-transferable, revocable license to use BotoxSearch, limited to personal use. All intellectual property rights remain with The Friendly App Ltd. This license does not include trademark rights, copyrights, APIs, or other intellectual property rights.

12. Prohibited Uses

12.1. It is prohibited to use the App for:

Any illegal or immoral purposes
Encouraging others to commit illegal actions
Violating intellectual property rights
Harassing, defaming, intimidating, or harming others
Providing false or misleading information
Uploading viruses or malware
Collecting others' personal data
Spamming, phishing, or scraping activities
Circumventing security features
Automated access or "scraping" of clinic information for commercial purposes

12.2. We have the authority to suspend or terminate your access if you engage in prohibited activities, including but not limited to:

Using the App to harass or spam clinics
Attempting to reverse engineer the App
Copying or redistributing clinic information commercially
Violating intellectual property rights
Attempting to disrupt or compromise App security

12.3. You agree not to use software that sends more requests than a human reasonably could, or that attempts to overwhelm our servers.

12.4. You agree not to reverse engineer, decompile, or attempt to obtain source code from BotoxSearch. Legal action may be taken against violators.

12.5. If you observe unauthorized use of BotoxSearch content, please notify us at hello@thefriendlyapp.com.

12.6. If you believe any User has violated these Terms, you may report it to hello@thefriendlyapp.com. We will investigate and may restrict access or remove accounts as appropriate.

13. Violation of Terms

13.1. If you fail to comply with these Terms or Privacy Policy, we reserve the right to suspend or terminate your access without prior notice, as well as the right to reject, remove, or delete information in the system. Our failure to exercise any legal right does not mean we have waived such rights.

14. Termination

14.1. We may suspend or terminate your access to BotoxSearch if:

You violate these Terms or our policies
You do not have the legal right to use the service
Payment is not collected despite reminders
Required by law or regulatory decisions
You use information for purposes other than personal informational use
You copy, republish, or redistribute App content on other platforms
At our sole discretion for protection of the service

14.2. These Terms remain in effect until terminated by you or us. You may terminate by ceasing to use BotoxSearch and notifying us at hello@thefriendlyapp.com. Your account will be deleted within two business days, except for data required to be retained by law.

14.3. Upon termination, provisions regarding personal data protection and intellectual property rights remain in force.

15. Records

15.1. In disputes arising from use of BotoxSearch, all electronic and commercial records maintained by us, including user information, logs, and notifications, constitute definitive evidence.

16. Severability

16.1. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain valid and in force.

17. Governing Law and Dispute Resolution

17.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.

17.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
